The latest protection law, in existence since 1988, was created for the protection of newly developed semiconductor structures.
The semiconductor protection law provides the possibility of protecting the surface configuration of microchips, the socalled mask work. An issued semiconductor protection grants a ban on imitation and utilisation. In the event of unauthorised use, the proprietor has the right to claim for discontinuance and/or damages.
Protection covers 'three-dimensional structures of microelectronic semiconductor products (topographies), if and to such extent they indicate characteristic features'. As a rule, this is always the case when one´s own performances are involved which are not an everyday result of intellectual work.
